Note on Service-Specific Terms

These Terms govern general use of the ameliorawellness.com website. The Tending Circle service is governed by its own separate Terms of Service. Clinical therapy services are governed by your Informed Consent and our Notice of Privacy Practices. Please review the applicable documents for the specific service you are using.

The following definitions apply throughout these Terms. Capitalized terms have the meanings set out below regardless of whether they appear in singular or plural form.

Automatic Renewal Disclosure

If you subscribe to any paid service offered through this Website — including the Tending Circle — your subscription will automatically renew unless cancelled before the next billing date, as required by California's Automatic Renewal Law (Business and Professions Code § 17600 et seq.). Full disclosure of auto-renewal terms, cancellation instructions, and refund policies are provided in the applicable service terms at the time of enrollment.

Do Not Track

Our Website does not currently respond to Do Not Track (DNT) browser signals. We use Google Analytics to collect anonymized usage data. You may opt out at tools.google.com/dlpage/gaoptout.

Shine the Light

Under California Civil Code § 1798.83, California residents may request information about personal information disclosed to third parties for direct marketing purposes. We do not disclose personal information to third parties for direct marketing purposes.

Section 6
Termination

We reserve the right to suspend or terminate your access to the Website immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Website ceases immediately. Provisions of these Terms that by their nature should survive termination — including limitations of liability, disclaimers of warranties, and dispute resolution — shall survive.

Limitation of Liability

To the fullest extent permitted by California law, the Company and its affiliates, officers, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Website or Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of: (a) the amount you paid us in the three months preceding the claim, or (b) one hundred US dollars ($100).

For disputes that cannot be resolved informally, the parties agree to attempt mediation in good faith before initiating formal proceedings. Nothing in this section limits your rights as a California consumer to seek relief through the California courts or applicable consumer protection agencies, including the California Department of Consumer Affairs.
